Cookies and Similar Technologies

Our Site is hosted and operated using Wix and may use cookies and similar technologies that are necessary for website functionality, security, performance, preferences, and other purposes.

A cookie is a small data file stored on or associated with your browser or device. Cookies and similar technologies may enable the Site and its service providers to recognize a browser or device, maintain website functionality, protect the Site against fraud or misuse, understand website performance, and remember certain preferences.

The particular cookies and technologies used may change as the Site develops and as features are added or removed.

You may be able to control or delete cookies through your browser settings and, where available, through cookie or privacy controls presented on the Site. Blocking certain cookies may affect the availability or proper functioning of some Site features.

We will update this Policy and provide additional notices or consent mechanisms when required if our use of analytics, advertising, or other tracking technologies materially changes.

Categories of Sources

At this time, we generally obtain personal information directly from you when you interact with PINKLATES and automatically from your browser or device when you interact with the Site. We may also receive technical or operational information from service providers that support the Site. We do not currently purchase personal information about Pink List subscribers from data brokers.

4. How We Use Your Information

We may use personal information for legitimate business and operational purposes, including:

  • Providing, operating, maintaining, securing, and improving the Site;

You may unsubscribe from marketing emails at any time by using the unsubscribe mechanism contained in an applicable marketing email or by contacting us at hello@pinklatesstudio.com.

An unsubscribe request does not necessarily prevent us from sending non-promotional communications when necessary, such as communications concerning a request you submitted, security matters, or other administrative matters.

PINKLATES does not currently rely on this Policy alone as consent to send promotional text messages. If PINKLATES introduces SMS or text-message marketing in the future, applicable consent, disclosure, and opt-out procedures will be provided as appropriate.

6. Disclosure and Sharing of Information

We may disclose personal information in the circumstances described below.

Service Providers

We may provide information to vendors, contractors, and service providers that perform functions on our behalf or help us operate the Site and our business.

These may include categories of providers such as:

  • Website hosting and website-management providers;

  • Database and customer-management providers;

  • Email and communications providers;

  • Security and fraud-prevention providers;

  • Analytics or website-performance providers, if enabled;

  • Professional advisers; and

  • Other technology or operational service providers.

Our current website platform and hosting provider is Wix.

Service providers may process information as necessary to perform services for us and are subject to applicable contractual and legal obligations.

Legal Requirements and Protection

We may disclose information when we reasonably believe disclosure is necessary or appropriate to:

  • Comply with applicable federal, state, or local law;

  • Respond to a subpoena, court order, warrant, regulatory inquiry, or other lawful legal process;

  • Respond to lawful requests from governmental or law-enforcement authorities;

  • Protect or enforce our legal rights;

  • Investigate or prevent fraud, security incidents, or unlawful activity; or

  • Protect the rights, property, safety, or security of PINKLATES, our users, or others.

Business Transactions

Information may be disclosed or transferred as part of an actual or proposed merger, acquisition, financing, reorganization, sale of assets, dissolution, bankruptcy, or similar corporate transaction involving all or part of PINKLATES LLC.

Any successor entity’s handling of personal information will remain subject to applicable law.

7. Sale, Sharing & Targeted Advertising

PINKLATES does not currently sell personal information in exchange for money.

California privacy law may define certain forms of “sale” or “sharing” more broadly than ordinary use of those words, including certain disclosures associated with cross-context behavioral advertising. Accordingly, this statement should not be interpreted solely by reference to whether money changes hands.

Based on the current operation of the Site, PINKLATES does not knowingly sell personal information or knowingly share personal information for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act (“CCPA”).

If our practices change in a manner that creates additional rights or obligations under applicable privacy law, we will update our disclosures and provide any legally required privacy choices or opt-out mechanisms.

We do not knowingly sell or share the personal information of individuals under 16 years of age.

8. California Online Privacy Protection Act (CalOPPA)

PINKLATES operates a commercial website accessible to California consumers and maintains this Privacy Policy in accordance with applicable requirements of the California Online Privacy Protection Act (“CalOPPA”).

This Policy describes, among other things:

  • The categories of personally identifiable information collected through the Site;

  • How that information may be used;

  • The categories of third parties with whom information may be disclosed;

  • How users may contact us regarding their information;

  • Our online-tracking disclosures;

  • How material changes to this Policy will be communicated; and

  • The effective date of this Policy.

You may contact us at hello@pinklatesstudio.com to request that we review or correct personal information you previously submitted directly to PINKLATES. We may need to verify your identity before fulfilling a request.

9. California Do Not Track & Online Tracking Disclosures

Some web browsers provide a “Do Not Track” (“DNT”) setting or signal intended to communicate a user’s preference regarding online tracking.

There is not a universally adopted standard governing how every website must interpret traditional browser DNT signals. At this time, our Site does not respond to traditional browser Do Not Track (“DNT”) signals.

The Site and service providers supporting its operation may collect information regarding your interaction with the Site over time as necessary to provide, secure, maintain, analyze, or improve the Site. Third-party services integrated into the Site may also receive information when you interact with those services, subject to their own privacy practices.

If PINKLATES implements technologies that track users across unaffiliated websites or services for advertising purposes, or becomes legally required to recognize particular opt-out preference signals, we will update our practices and disclosures as required by applicable law.

10. California Consumer Privacy Act / California Privacy Rights Act

The California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), applies to businesses that satisfy particular statutory requirements. A company’s location in California alone does not make it subject to all CCPA requirements.

As of the effective date of this Policy, PINKLATES does not represent that it meets the statutory thresholds that would make it a “business” subject to all requirements of the CCPA.

California’s current thresholds generally include businesses meeting at least one qualifying criterion concerning annual gross revenue, volume of California consumer or household information bought, sold, or shared, or the percentage of revenue derived from selling or sharing California consumers’ personal information.

If PINKLATES becomes subject to the CCPA/CPRA, we will update our privacy notices and processes as required, including applicable rights concerning access/knowledge, deletion, correction, sale or sharing, limitation of certain uses of sensitive personal information where applicable, non-discrimination, and other rights provided by law.

Nothing in this Policy is intended to restrict any privacy right that an individual has under a law that independently applies to PINKLATES.

11. Your Privacy Choices

Regardless of whether a particular statutory privacy law requires PINKLATES to provide a specific right in a particular circumstance, you may contact us regarding personal information you have directly provided to us.

You may request that we:

  • Provide information concerning personal information you submitted to us;

  • Correct inaccurate information;

  • Delete certain information, where reasonably practicable and not required to be retained for legitimate business or legal purposes; or

  • Stop sending you promotional email communications.

Requests may be submitted to hello@pinklatesstudio.com.

We may request information reasonably necessary to verify your identity and protect your information from unauthorized access or deletion.

Certain requests may be limited or declined when retaining or processing information is reasonably necessary to comply with law, maintain security, prevent fraud, resolve disputes, enforce agreements, establish or defend legal claims, or fulfill other legitimate purposes permitted by applicable law.

We will not discriminate against an individual for exercising a privacy right that applies to them under applicable law.

12. Data Security

PINKLATES and the service providers supporting our Site use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, acquisition, loss, misuse, alteration, or disclosure.

However, no website, electronic communication, database, or method of transmitting or storing information can be guaranteed to be completely secure. Accordingly, we cannot guarantee the absolute security of personal information.

You are responsible for exercising appropriate care when transmitting information over the internet.

13. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy or the purposes disclosed when the information was collected.

The appropriate retention period may depend upon factors including:

  • The nature and amount of the information;

  • The purposes for which it was collected;

  • Whether an individual remains subscribed to the Pink List;

  • Operational and business needs;

  • Security and fraud-prevention needs;

  • Applicable statutes of limitation; and

  • Legal, accounting, regulatory, reporting, or compliance requirements.

When information is no longer reasonably required, we may delete, anonymize, or otherwise dispose of it in accordance with our practices and applicable law.

14. Third-Party Websites, Services & Social Media

The Site may contain links to or integrations with third-party websites, applications, and social media platforms, including social networks on which PINKLATES maintains official accounts.

When you select a third-party link or interact with a third-party service, you may leave our Site or otherwise interact directly with that third party.

PINKLATES does not control the privacy, security, cookie, or data-processing practices of independent third parties. Your interaction with those services is governed by their respective terms and privacy policies.

The inclusion of a link to a third-party service does not mean that PINKLATES controls that service’s privacy practices.

We encourage you to review the applicable privacy policies of third-party services before providing personal information to them.

15. Children’s Privacy

The Site is intended for a general audience and is not directed to children under 13 years of age.

We do not knowingly collect personal information online from children under 13 without legally required parental consent.

Children under 13 should not submit personal information through the Site, including through the Pink List or contact forms.

If we learn that we have collected personal information online from a child under 13 in circumstances requiring parental consent and such consent was not obtained, we will take reasonable steps to delete the information.

Parents or legal guardians who believe a child under 13 may have provided personal information to PINKLATES may contact us at hello@pinklatesstudio.com.

16. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technology, services, Site features, or applicable legal requirements.

When we update this Policy, we will revise the “Last Updated” date displayed at the top of the Policy.

If changes materially affect how we handle personal information, we may provide additional notice when appropriate or required by applicable law.

We encourage visitors to review this Policy periodically.
